In order to improve the labeling of genetically modified agricultural organisms in Shanghai, the following requirements for the regulation of the labeling have been made.

A. The administration departments responsible for the labeling of genetically modified agricultural organisms in Shanghai
In order to implement and improve the supervision, examination and approval of the labeling of genetically modified agricultural organisms in Shanghai, after careful consideration, the following three departments shall be responsible for the supervision, examination and approval of the labeling within the administrative area of Shanghai after consideration.

B. The application for and examination of the labeling of genetically modified agricultural organisms
1. Application for the labeling
According to what is stipulated in Approaches of Labeling, production units, packing units and individuals shall be responsible for the labeling of genetically modified agricultural organisms that have been listed in the category. Re-labeling is required if businesses and individuals have unpacked the original packaging for sale. Therefore, all production, operation units or individuals that are engaged in the production and sales of genetically modified agricultural plant seeds, breeding stock and fowl, aquatic seedlings and genetically modified agricultural biological products and their processed products shall apply to the relevant examination and approval department for labeling. The labeling of genetically modified agricultural organisms is applied to imported products that are directly sold or sold after packing and processing in Shanghai and products manufactured, processed and then sold in Shanghai. The following documents shall be provided for the application for the examination and approval of the labeling:
(1)  Application form for the examination and approval of the labeling to be ratified;
(2)  The pattern of the label;
(3)  Statement of the label (for instance, the size of the label, the proportion, color, location on the packing, solidness, adhesion, etc.);
(4)  Statement of the use of the label during transportation;
(5)  The security certificate of genetically modified agricultural organisms issued by the Ministry of Agriculture and the duplicate copies of relevant documents ratified;
(6)  Other relevant documents ratified (for instance, the variety approval certificate, registration
 certificate of agricultural chemicals, registration certificate of fertilizers, certificate of new
veterinary medicine and its production license and business license, etc.);
(7)  Other documents required for the examination and approval of the labeling.
2. Examination of the labeling
The examination and approval department shall make a resolution for the examination and approval 30 days from the date of receiving the application for examination and approval of the labeling and shall inform the applicant of the result. The examination includes verifying:
(1)  whether the documents for application are ready, complete, true and reliable;
(2)  whether the content of labeling is consistent with that in the security certificate of genetically modified agricultural organisms (including species of the organism, components and range of adaptability, etc.);
(3)  whether the label is in consistency in content and form with the features or characteristics of
the products manufactured and sold;
(4)  whether the label is in harmony with the tag stuck;
(5)  whether the Chinese used on the label is standard;
(6)  whether the label is in consistency with other revenant documents ratified;
(7)  whether the label is clear and conspicuous.

C. Other items for attention in applying for the labeling of genetically modified agricultural organisms
1. According to what is stipulated in Label Management Approaches and Procedures, applicants shall provide security certificate or temporary testimonial for the examination and approval of the labeling. However, agricultural products imported before March 20th, 2002 do not need to provide security certificate or temporary testimonial for the application;
2. In case any one of the components of the mixed oil (meal, powder, soy sauce, etc) is listed in the category and is in its original existence, labeling is required;
3. With regard to the genetically modified agricultural products to be imported for processing and sales, the application for the labeling of this process is required only once if one and the same company shall be responsible for the whole business procedure;
4. According to the relevant regulations on labeling, labels, once ratified, shall be in common use except for requirements in some specific areas;
5. Genetically modified agricultural organism to be manufactured and sold shall apply for labeling and use of labels in accordance with their packing designs, the change of which will lead to re-application;
6. Labels of genetically modified agricultural products, once ratified, shall remain valid before the way of labeling or the components of the product or the brand of the product is to be changed.

D. Re-examination & re-approval and nullification of labels
1. Re-examination and re-approval
 Labels of genetically modified agricultural organisms that have been approved shall re-apply for the examination and approval of labeling following the original procedures for application under the following circumstances:
(1)  The security certificate of genetically modified agricultural organisms is expired;
(2)  The genetically modified agricultural products provided by the supplier are not the products of the same batch specified for import;
(3)  The packing design has been changed;
(4)  The pattern of the label has been changed;
(5)  The type of the products has been changed after processing;
(6)  Other factors that necessitate the re-application for the examination and approval of labeling.
2. Nullification of labels
Labels shall be nullified under the following circumstances:
(1)  When the security certificate of genetically modified agricultural organisms has been canceled or the production license and business license have been revoked;
(2) When enterprises with a need for re-application for the examination and approval of labeling fail to re-apply or when their re-application for the examination and approval of labeling is not ratified;
(3) When the enterprises have been ordered to suspend production and sales of their products in accordance with related laws and regulations.

Units and individuals concerned shall submit their applications to relevant departments of examination and approval for ratification upon the issuance of the notice.

To ensure the implementation of the Notice and of the relevant regulations in Shanghai, the Municipal Government of Shanghai will organize relevant departments to launch a legal inspection in the circulation field with the focus on the labeling of genetically modified agricultural organisms, commending units that conduct strict management of labeling and investigating into and dealing with, in accordance with laws, units that transgress regulations on labeling management or do not conform to the procedures of labeling management.
